IOW LEG OSHA Discrimination Rules


On Oct. 16, IOW LEG proposed to protect employees from retaliation.


  • IOW LEG Labor Services Division proposed replacing IOW LEG 875-9 to protect employees from retaliation when employees make a work safety complaint to OSHA.
  • Provided a redline of the proposed new chapter 9 on page 623 of the IOW register.

  • Would rescind the current chapter 9 entitled Discrimination Against Employees, and adopt a new chapter 9 entitled, OSHA Discrimination Against Employees in its place.
  • New rules cover OSHA complaints and proceedings, filing of complaint for discrimination, notice of determination, and arbitration or other agency proceedings.

  • Two public hearings will be held on Nov. 5 and Nov. 6, 2024 from 8:30 to 9 a.m.
  • Comments on the proposal are due on or before 4:30 p.m. on Nov. 6, 2024.

  • On Dec. 11, 2024, IOW LEG published adoption in State register, Jan. 15, 2025 effect.
