SWE GVT issued legislative council referral re proposed supplementary provisions to the EU rules on digital markets, EU rules on foreign subsidies and competition law.
Main Points
Proposal for Swedish Competition Authority to request assistance from the Swedish Enforcement Agency (Kronofogden) when assisting the EC with on-site investigations.
Also to be given certain powers to independently carry out on-site investigations and investigative measures, at EC's request, re market distortions by foreign subsidies.
Changes to ensure that data from individuals submitted to the Swedish Competition Authority as a result of the EU regulation on digital markets will remain confidential.
Changes are also proposed regarding the national block exemptions for anti-competitive specialization agreements and anti-competitive agreements on R&D.
Effectiveness
The legal changes are proposed to enter into force on Dec. 1, 2024.

On May 28, 2024, SWE GVT issued final version of bill on supplementary provisions to new union rules in the field of competition, expanding authority's tasks.
Data from individuals submitted to the Swedish Competition Authority as a result of the EU regulation on digital markets will be ensured to be subject to confidentiality.

Sep. 26, 2024 SWE CMP Welcomed Competition Bill Adoption
On Sep. 26, 2024, SWE CMP welcomed adoption of the bill on supplementary provisions to new Union rules in the field of competition, adopted on Sep. 26, 2024.
Riksdag adopted bill giving SWE CMP powers to help in EU CMSN site investigations, and other measures, to determine if a foreign subsidy distorts internal market.
The bill also implements changes on national block exemptions for anti-competitive specialization agreements and anti-competitive research and development agreements.
Changes mean same substantive regulation must apply as for group exemptions at EU level; the changes to the law enter into force on Dec. 1, 2024, as initially proposed.
