CZC FIU issued the consolidated version of Act 253/2008 Coll., on certain measures against legalization of proceeds from criminal activity and the financing of terrorism.
Follows CZC FIU Jan. 2021 issued consolidated text of AML law, see #70920.
Purpose
Consolidation due to changes made by Act 107/2024 Coll., amending Act 253/2008.
CZC FIU made available a consolidated version with indications of the changes made.
Effectiveness
The consolidated AML Act became effective on May 1, 2024.
On Sep. 26, 2024, CZC PRL published Act 280/2024 coll. amending Act 253/2008 coll., on certain measures against the legalization of proceeds from criminal activities and the financing of terrorism, as amended, and other laws; in force on Dec. 30, 2024.
Amendments to integrate provisions for crypto-assets; new obligation re identification of represented client of the lawyer or notary; monitoring of suspicious transactions.
Designation of a specific employee or member of the statutory body to fulfill the reporting obligation of the obliged entity; new section 25b re virtual assets' providers.
New section 29b on provisions for cross-border service providers; new sections 41a and 41b on reporting obligation for cash transport over €15,000; customs' missions.
New sections 42a, 42b, 42c, on cash retention, tax code and refund of withheld cash.
Amendment of the Act on the Implementation of International Sanctions to integrate UN Security Council's decisions; change to the Act on International Tax Cooperation.
Act takes effect on Dec. 30, 2024, with the exception of the provisions of parts two and three, which take effect on the day following its promulgation, on Sep. 27, 2024.
Nov. 3, 2024 Future Version
On Nov. 3, 2024, CZC PRL published law of Mar. 6, 2024, Act 107/2024 Coll Act amending Act No. 253/2008 Coll., on certain measures against legitimisation of proceeds of crime and financing of terrorism, as amended, and other related acts.
Included future version of act, as fully in force Jan. 1, 2025.
It will come into force on Dec. 30, 2024 and Jan. 1, 2025; version was drawn up on basis of comparison created by Collection of Laws and has changes of Act 280/2024.
