CHL GVT Occupational Risks


On Jul. 27, CHL GVT approved new rules on preventive management.


  • GHL GVT published Decree 44 to implement new regulations regarding preventive management of occupational risks for safe and healthy work environment.
  • Background
  • CHL GVT committed to promote the International Labor Organization's concept of decent work and gender equality, understood as productive work in various conditions.
  • Law 16.744 established standards for the prevention of occupational risks.
  • Imposed obligations re safety and health at work that are required in all workplaces.
  • Title VII regulated by Supreme Decree 40 of Ministry of Labor and Social Security.
  • Supreme Decree 40 has only been modified by Supreme Decree 50 of 1988 of the Ministry of Labor and Social Security, adding Title VI Obligation to report risks.
  • Also Supreme Decree 95, which replaced Title III Risk Prevention Departments.
  • It is necessary to establish new regulations on management for the prevention of occupational risks, thus repealing Supreme Decrees 40 and 54, both of 1969.

  • Article 184 of the Labor Code required employers to take measures to effectively protect the life and health of workers, to manage occupational risks in the workplace.
  • Employer must record and support in a documentary and reliable manner information re management of occupational risks that it conducts in accordance with regulation.
  • Inspection, oversight and penalizing of violations or non-compliance with these regulations that occur in the workplace will be conducted by the Regional Ministries.
  • Effectiveness
  • Decree 44 shall come into force 1st day of 6th month following official publication.
