GHL GVT published Decree44 to implement new regulations regarding preventive management of occupational risks for safe and healthy work environment.
Background
CHL GVT committed to promote the International Labor Organization's concept of decent work and gender equality, understood as productive work in various conditions.
Law 16.744 established standards for the prevention of occupational risks.
Imposed obligations re safety and health at work that are required in all workplaces.
Title VII regulated by Supreme Decree 40 of Ministry of Labor and Social Security.
Supreme Decree 40 has only been modified by Supreme Decree 50 of 1988 of the Ministry of Labor and Social Security, adding Title VI Obligation to report risks.
Also Supreme Decree 95, which replaced Title III Risk Prevention Departments.
It is necessary to establish new regulations on management for the prevention of occupational risks, thus repealing Supreme Decrees 40 and 54, both of 1969.
Highlights

Establishes obligations that employers must comply with for preventive management of professional or occupational risks to guarantee safe and healthy environment.
Standards pertain to establishment, operation of Joint Health and Safety Committees.
Finally, special regulations are available so that administrative bodies of Law 16.744 comply with their obligation to conduct permanent risk prevention activities.
Also, to provide technical assistance so employers can comply with listed obligations.
Article 184 of the Labor Code required employers to take measures to effectively protect the life and health of workers, to manage occupational risks in the workplace.
Employer must record and support in a documentary and reliable manner information re management of occupational risks that it conducts in accordance with regulation.
Inspection, oversight and penalizing of violations or non-compliance with these regulations that occur in the workplace will be conducted by the Regional Ministries.
Effectiveness
Decree 44 shall come into force 1st day of 6th month following official publication.
