Bill Provisions
In overpayments of benefits involving $1000 of more obtained as a result of fraud, administrator to refer information to office of district attorney where claimant resides.
Acceptance of such overpayment shall be considered a crime of theft upon proof beyond reasonable doubt that the overpayment obtained by fraud or false pretenses.
No criminal referral, conviction necessary for administrator to assess any civil penalty.
