CAL LEG passed bill AB 2747, adds CAL LEG 3-4-2.4-1954.07 re tenant credit reports.
Requires landlord to offer tenant on a lease the option of having the tenant’s positive payment information reported to at least one nationwide consumer reporting agency.
Bill Provisions
For leases entered into on and after Apr. 1, 2025, offer of positive rental payment information reporting made at the time of lease agreement and annually thereafter.
Leases outstanding as of Jan. 1, 2025, the offer of positive rental payment information reporting to be made no later than Apr. 1, 2025, and at least once annually thereafter.
The bill authorizes a tenant to request, and the landlord to provide, additional copies of the written election of positive rental payment information reporting at any time.
A tenant who elects to have positive rental payment information reported is to subsequently file a written request to stop that reporting and landlord is to comply.
Tenant who stops reporting prohibited from electing reporting again for 6 months.
Landlord to charge a tenant the lesser of $10 per month or the actual cost of service.
Unless landlord does not incur any actual cost to provide positive payment reporting.
Prohibits landlord from taking certain actions if tenant fails to pay reporting charge.
Exempts a landlord of a residential rental building that has 15 or fewer dwelling units, unless specified conditions are met, and an assisted housing development, as defined.
