  • NY LEG published EO 37, declaring a disaster due to severe storms and extreme heat.

  • Storms and heat have caused hazardous conditions posing an imminent danger to public transportation, utility service, public health, as well as public safety systems.
  • Series of severe storms combined with extreme heat that began on Jul. 10, 2024.
  • Produced tornadic activity, damaging straight-line winds, heavy rainfall, and flash flooding, resulting in road closures, travel disruptions, widespread power outages.
  • Executive Order implements the State Comprehensive Emergency Management Plan.
  • Authorizes, effective Jul. 10, 2024, State agencies to take the appropriate action to protect State property and to assist affected local governments and individuals.
  • EO is applicable for the counties of Albany, Allegany, Bronx, Broome, Cattaraugus, Cayuga, Chautauqua, Chemung, Chenango, Clinton, Columbia, Cortland, Delaware.
  • Also Dutchess, Erie, Essex, Franklin, Fulton, Genesee, Greene, Hamilton, Herkimer, Jefferson, Kings, Lewis, Livingston, Madison, Monroe, Montgomery, Nassau, New York.
  • Niagara, Oneida, Onondaga, Ontario, Orange, Orleans, Oswego, Otsego, Putnam, Queens, Rensselaer, Richmond, Rockland, St Lawrence, Saratoga, and Schenectady.

  • Aug. 2024 SBA Loans for Non-Profits
  • On Aug. 30, 2024, SBA reported that certain Private Non-Profits (PNPs) that do not provide critical services of a governmental nature may be eligible for disaster loans.
  • Specifically, they are eligible for low-interest disaster loans for damages as a result of severe storm, tornadoes and flooding that occurred on Jul. 10 to Jul. 11th.
  • Eligible PNPs in counties of Cortland, Essex, Hamilton, Lewis and St. Lawrence may apply; eligible PNPs include food kitchens, homeless shelters, museums, libraries.
  • PNPs may borrow up to $2mn to repair or replace damaged or destroyed real estate, machinery, equipment, inventory, other business assets at interest rate of 3.35%.
  • Applicants may be eligible for a loan amount increase of up to 20% of physical damages, as verified by the SBA, for mitigation purposes such as insulation.
  • May also be eligible for Economic injury disaster loans (EIDLs) for operating costs.
  • Deadline for physical property damage is Oct. 28, 2024; for EIDLs is May 29, 2025.

  • On Sep. 5, 2024, SBA published notice of disaster declaration for public assistance only for NY due to sever storms, tornadoes, and flooding from Jul. 10 to Jul. 11, 2024.
  • Private Non-Profits that provide essential governmental services may file. for loans.
  • Sep. 10, 2024 NY LEG SBA Loans Program
  • On Sep. 10, 2024, NY LEG reported SBA federal loan assistance to firms impacted by Jul. 10 - Jul. 11 severe weather in Lewis and Essex counties and contiguous counties.
  • Clinton, Franklin, Hamilton, Herkimer, Jefferson, Oneida, Oswego, St. Lawrence, Warren, and Washington counties, to address physical losses or else economic injury.
  • Loans up to $2mn to replace real property, inventories, machinery, equipment or other physical loss; economic/working capital loans up to $2mn for businesses, non-profits.
  • Program also provides homeowner and renter property repair and replacement loans.
  • Deadlines: physical property damage, Nov. 8, 2024; economic injury, Jun. 9, 2025.
  • Sep. 11, 2024, NY LEG Extends Emergency
  • On Sep. 11, 2024, NY LEG Governor Hochul extended the Jul. 16, 2024, Executive Order No. 37 declaring a State Disaster Emergency for all counties in New York.
  • Emergency is now extended via Executive Order 37.1, through Sep. 14, 2024.
