NY LEG passed bill A 5729 (S 6146 ) requiring certain insurers to provide coverage for tattooing performed by a physician as part of breast reconstruction surgery. Amends NY INS 28-32-3216 , individual accident and health policy; NY INS 28-32-3221 , group or blanket insurance; NY INS 28-43-4303 , nonprofit indemnity, benefits. Bill Provisions Requires coverage of breast tattooing following a mastectomy or partial mastectomy. Provided such tattooing is performed by licensed physician or other health practitioner. Medical breast tattooing should not be considered as a cosmetic, elective procedure. Legislative History On Mar. 23, 2023, bill was introduced in Assembly; on Jun. 1, 2023, passed Assembly. On Jun. 1, 2023, bill was delivered to the Senate; on Jan. 3, 2024, bill died in Senate. On Mar. 14, 2024, bill again passed in Assembly; on May 29, 2024, passed in Senate. Effectiveness Act shall take effect on Jan. 1 succeeding the date on which it shall become a law. Aug. 2024 NY LEG Governor Approval On Aug. 26, 2024, NY LEG reported governor signed AB 5729 / SB 6146, as Ch. 228.
