CZC GVT approved proposal for comprehensive amendment to Act on Prices 526/1990.
It has been in force for +34 years and was last significantly amended in 2009.
Draft aims to amend Act 526/1990 Coll., on prices, as amended, other related laws.
Material presented in accordance with Government's Legislative Work Plan for 2023.
Overview
The aim of the draft is primarily to eliminate cases in which powers of individual price authorities to exercise price controls unnecessarily overlap.
It has other legislative, technical changes that will simplify, clarify existing legislation.
Main changes include unification of inconsistent definition of powers of individual price authorities, of rules for issuing price decisions or of terminology across all price regs.
Price decisions will be newly issued in form of measures of general nature, not in form of subordinate legal regulations not specifically named by law, as was case until now.
As result, individual cases of price regulation will have to be justified to a wider extent.
Decision on price regulation will now be subject to judicial review according to Section 101a et seq of the Administrative Code of Court.
Pursuant to draft, Ministry of Finance will issue a new decree with a list of packaged non-food goods, which must be marked with selling price.
Selling price will give the consumer possibility of easy and reliable price comparison.
This decree will replace the existing decree of the Ministry of Industry and Trade.
In same way, law on jurisdiction of authorities in the area of prices, the so-called Price Competence Law, will be repealed and its content directly integrated into Act on Prices.
Basic principles of Act on Prices, including legal reasons when possible to regulate price of certain goods remain preserved, proposed amendment takes effect on Jan. 1, 2025.
