The standard is divided into 4 sections, namely the provision of information re assets with trading restrictions, participant's duty to monitor, BSM's action, and enforcement.
Information on assets with restrictions are available on the B32 website, and data in OTC segment is available directly in the organized over-the-counter market system.
Organized markets participants must continuously monitor compliance with the rules restricting the trading, and implement pre-trade/post-trade effective internal controls.
For requesting the transfer of securities, participant must pay attention to the investor category, ensuring transfer procedures comply with security/transparency standards.
Must also ensure the operation is adequate for the risk profile and need of the investor.
Monitoring for compliance may be carried out through the identification of assets with trading restrictions through the data page on the website or through the OTC market.
Failure to comply with duties in the standards, will be subject to enforcement action.
Effectiveness
Supervisory Standard will come into effect as of Jan. 2, 2025.
