Guidelines
Ensure that sentences are consistent, just and proportionate and to promote public understanding and confidence in sentencing and in the criminal justice system.
Establish the parameters of seriousness and set out the approach to sentencing.
Determinants of seriousness are described relating both to the harm caused (or likely to be caused) by the offending behavior and to the culpability of the offender.
For many offences of dishonesty, the value involved is important factor in seriousness.
For example, blackmail and handling stolen goods have maximum penalty of 14 years.
In sentencing an offender, the Court has to balance a number of competing interests and objectives, tailoring the punishment to individual circumstances of the offender.
And ensure that the punishment is commensurate with the seriousness of the offence.
Offences include offences against public order, offences against the administration of lawful authority, offences injurious to the public in general, offences against the person, anti-gang provisions, offences relating to property, bad driving, and forgery.
