Overview
It is planned structure of collegial work will change and compensation fund abolished.
New statute introduces recommendations Council's structure committee came up with in spring and the Compensation Fund will be transformed into an insurance scheme.
The plan is for statute to enter into force on Jan. 1, 2025, but before, consequential changes to Administration of Justice Act must be formally adopted by the DEN PRL.
Chairman is pleased that major step has been taken towards modernizing and future-proofing the foundation for important collegial work around which the DEN BAR is built.
To have significantly better overall framework which will ensure it can attract more lawyers to collegial work, many as possible can be represented in DEN BAR bodies.
In recent years, in some legal circles, more difficult to get lawyers to stand for election to Bar Council, one move to meet challenge is to have fewer but larger lawyers circles.
The current 8 bar associations will become 5 when the new statute enters into force.
To create greater interest in elections held by the legal circles, DEN Bar will also introduce digital elections, as support for the physical elections has been declining.
Another change when new bylaws in force is that Compensation Fund will be abolished.
It covers losses of clients, others if lawyer is responsible for loss e.g. if embezzlement committed, lawyer's liability insurance or guarantee does not or only partially covers it.
From now on, such losses will be covered by an insurance taken out by the DEN BAR.
There has been dialogue with Ministry of Justice re changes to the bylaws that require changes to the law and it is expected that a bill will be presented in the autumn.
I.e. a bill that implements these changes in the Administration of Justice Act.
Effectiveness
Subject to amendments required, new bylaws will enter into force on Jan. 1, 2025.
