BRZ IPO reported Phase V of Patent Prosecution Highway (PPH) pilot project is starting
The Phase V of PPH pilot commences on Jan. 1, 2025 with new functionalities.
Overview
Ordinance/INPI/48 instituted Phase V, pursuant to which BRZ IPO will accept PPH requests for patent applications whose priority is not from a Partner IP Office.
It will also accept any technical examination result that indicates there is patentable matter (novelty, inventive step and industrial application) issued by a Partner Office.
This is the case irrespective of whether as national, regional or international authority.
Up to 3,200 PPH participation applications will be received per annual cycle.
Also up to 1,000 participation applications may be made in the same Section of the International Patent Classification, including applications filed under the PCT.
To apply for the GPPH, the depositor or his attorney must restrict the claim framework to the matter considered patentable in the Office of Previous Examination (OEE).
Application can be requested at participating Offices of Second Examination (OLE).
Effectiveness
Phase V will be effective on Jan. 1, 2025; Ordinance/INPI/PR nº 78/2022 is revoked.
