  • Background
  • Today, BER GVT informed that the Personal information protection amendment (PIPA) Bill of 2023 was tabled in the House of Assembly on June 2, 2023.
  • The bill has as its purpose to amend the Personal information protection Act 2016.
  • Makes significant amendments to the Public access to information act 2010.
  • Additionally, it amends the Public access to information regulations 2014.
  • Essentially the Bill seeks to harmonize the PIPA and PATI legislation.
  • This harmony moves the Government a step closer to implementation of PIPA.
  • Tomorrow, BER GVT will be debating this matter in the House of Assembly.

  • Legislation is very critical and should matter to residents and businesses.
  • The aim of the PIPA is to put the control over the use of personal information into the hands of individuals; privacy is often confused with public access to information.
  • These two concept share similarities, but in reality are quite different.
  • PIPA is designed to meet international best practice, competitors already comply.
  • In preparation for PIPA, SMEs, entrepreneurs will get special assistance and guidance.

  • On Jun. 16, 2023, BER GVT updated Public access to information act (PATI) and its regulations; harmonizes PATI with the Personal information protection act 2023 (PIPA)
  • Will move forward with Reasonable Charges for PATI in accordance with UK Freedom of information and data protection regulations 2004 to create fixed vs. variable fee policy.
  • Fees related to fulfilling public records requests, e.g., microfilm, copies, videos, photos.
  • Updates to come in force upon publication of the notice in the Bermuda official gazette.

  • On Jul. 5, 2023, BER PRL passed Personal information protection amendment act 2023
