On Jul. 10, NLD GVT amended reg on NLD AFM, NLD DNB fees.
NLD GVT published Regulation 2024-0000362907 of Jun. 28 2024, amending the Regulation on the financing of financial supervision of one-off actions in connection with the performance of actions under Reg 2023/1114 on markets in crypto assets.
Main Points
Reg sets the rates that NLD AFM and NLD DNB can charge for certain actions that they perform under MiCA; new components are added to art 4 and 5 of the Regulation.
Regarding FR AFM, the changes concern the rate amounts for granting and amending licenses, notifications and assessments of persons for crypto asset service providers.
NLD DNB can charge rates for assessing license applications from ART issuers.
Processing notifications of the issuance of EMTs by banks and e-money institutions and for assessing acquisition plans from ART issuers and crypto asset service providers.
The costs incurred by NLD AFM, NLD DNB for performing a one-off transaction are charged directly to the institution concerned, regardless of the size; tariffs may differ.
An hourly rate applies for a number of one-off transactions by NLD AFM, because the scope of the work involved can vary greatly and cannot be determined in advance.
NDL DNB uses fixed rates instead, regardless of the supervisory effort made any costs that are not covered by the rate are charged as part of the levy for ongoing oversight.
Effectiveness
This Regulation enters into force on Dec. 30, 2024, with the exception of article I, section B, para 2, which will apply on the date on which art I of the MiCA and TFR Implementation Decree enters into force.
