UK DSIT published the Online safety act 2023 (pre-existing part 4B services assessment start day) regulations 2024 (StIn 2024/571), made on Apr. 24, 2024.
Follows UKP, UK DSIT Nov. 2023 commenced the online safety act, see #192444.
Summary
These regulations specify the date from which video-sharing platforms (VSPs) known as pre-existing Part 4B services are subject to the requirement to complete assessments, in line with section 9 (illegal content risk assessment duties).
As well as section 11 (children’s risk assessment duties) and section 35 (children’s access assessments or CAAs) of the Online safety act 2023 (the 2023 Act).
UK-established VSPs are pre-existing part 4B services if they meet the definition in paragraph 7 of part 3 of schedule 3 to the 2023 Act (pre-existing part 4B services).
From the assessment start day, or the date that OFCOM publishes the first illegal content assessment guidance (whichever is the latest), pre-existing Part 4B services have three months to complete the first illegal content risk assessment.
If, on assessment start day, no guidance has been published on CAAs or section 15(2) assessments, then pre-existing Part 4B services will have three months from the date that guidance is issued to complete assessments for which guidance has been issued.
If, on assessment start day, guidance has been published on CAAs or section 15(2) assessments, then pre-existing Part 4B services will have three months from the assessment start day to complete assessments for which guidance has been published.
Effectiveness
The regulations come into force on May 22, 2024.
