On Apr. 30, BRZ CB issued resolution to regulate registry of persons.
BRZ CB issued Resolution 376 to regulate the Registry of Persons Responsible for Resolution Regimes (Caresp) and designate intervenors, liquidators, board of directors.
Register of Persons
Caresp will be managed by Department of Resolution and Sanctioning Action (Derad).
Derad will forward to the competent authority by the designation list containing the top ten classifieds registered in the Caresp to act in the appropriate geographical area.
Is based on compatibility/availability; where there is a tie, all names will be included.
A natural person can be included in Caresp if they have higher education, technical knowledge, professional experience, not disqualified/suspended from certain entities.
Natural person must not have any financial issues, including, not have controlled or administered a company that has undergone bankruptcy, judicial recovery, collections.
Also stated conditions under which a legal entity will be able to exercise Caresp duties.
Effectiveness
Resolution 176 effective Jun. 3, 2024; Ordinance 94,854 of Sep. 13, 2017 is repealed.
