Determination Provisions
Energy independence and security act (EISA) (PL 110-140) set procedures for HUD to consider adopting periodic revisions to International Energy Conservation Code (IECC).
Also to ANSI/ASHRAE/IES Standard 90.1: Energy Standard for Buildings, Except Low-Rise Residential Buildings (ASHRAE 90.1), subject to negative affect determination.
Also, subject to a determination that the revisions improve energy efficiency.
At the time of preliminary determination, most recent editions of the codes for which DoE had issued efficiency determinations were ASHRAE 90.1-2019, and 2021 IECC.
After comment review, determined 2021 IECC and ASHRAE 90.1-2019 energy codes will not negatively impact the affordability or availability of housing covered by EISA.
Effectiveness
Determination effective May 28, 2024; compliance dates vary by program type.
For FHA-insured multifamily programs, applicable to properties for which mortgage insurance pre-applications received 12 months after effective date of determination.
FHA-insured single-family loan programs, applicable to new construction where building permits applications submitted on or after 18 months after May 28, 2024.
HOME and Housing Trust Fund programs, applicable to residential new construction projects for which HOME/HTF funds are committed on or after 180 days after May 28.
Public housing capital fund standards, applies to approvals of development proposals for new capital fund/mixed financed projects on/after 12 months from May 28, 2024.
