BEL PRL announced adoption of bill via doc no 55K3885; the adoption took place on Apr. 18 by plenary session post short legislative procedure started on Mar. 12, 2024.
The post declaration of urgency requested by BEL GVT per art 51 of Regs was granted.
Effectiveness
The new law will be officially published shortly and enter into force on Jun. 1, 2024.
The text adopted by the plenary is identical to the text adopted by the Committee on Environment and Climate Affairs via Doc 55 3885/003 on Apr. 3, 2024.
May 2024 Legislation Published
On May 14, 2024, BEL GVT published the final legislation confirming that the Federal Public Service Economy, SMEs, Middle Classes and Energy may process data, including personal data in the meaning of the law of Jul. 30, 2018, for monitoring compliance.
Legislation applies to any member of staff or person who is member of administrative, management or supervisory body, or who has the power of representation, decision-making or control, of a company or group of companies concerned in processing data.
As part of the options, relevant persons can process name, first names, e-mail address and home address, capacity, as well as the position occupied by the person concerned.
The processing of all such personal data is to be carried out in accordance with EU Reg 2016/679 (GDPR) of EP and EU CNCL of Apr. 27, 2016 on protection of natural persons with regard to the processing of personal data and the free circulation of these data.
Processing and storage of personal data is limited to duration to achieve objective for which data is, and cannot exceed ten years after end of last capacity provision period.
Now that the new law has been officially published, it will enter into force Jun. 1, 2024.
