Bill Provisions
Amends offense of defrauding of creditors to increase penalty based on value of fraud.
The act of defrauding of creditors to include the hindering of enforcement of the security interest and depriving the secured party of lawful possession of the property.
Violation is a class A misdemeanor if unpaid balance owed to the creditor is less than $10,000, third degree felony if unpaid balance owed to creditor is or exceeds $10,000.
Does not impose liability on law enforcement officer acting in scope of investigation.
