On Mar. 18, ARK LEG enacted bill to repeal setting aside for quiet titles

  • ARK LEG enacted bill SB 298 to repeal ARK LEG 18-5-60-5-510 concerning the setting aside of a decree to quiet title to land to allow for finality in quiet title actions.

  • Repeals the section which specifies that any person may appear within three (3) years and set aside the decree if he or she shall offer to file a meritorious defense.
  • Also repeals provision that persons under disability of infancy or mental illness or intellectual disabilities, may set aside the decree within 3 years after disability removal
