On May 2, CYP SEC issued rules for management companies, funds.
CYP SEC issued Cir E705 to management companies and internally managed funds for electronic submission of information for year 2024 (Form RBSF-MC).
Overview
The circular was issued pursuant to section 25(1)(c)(ii) & (iii) of the CySEC Law.
New version of form RBSF-MC, Version 8 issued, can be found in the Appendix.
This form is issued on annual basis and aims to collect various statistical information.
CYP SEC will use information, for purposes of statistical analysis, risk management etc.
Form must be completed, successfully submitted by all Regulated entities authorized, appointed or approved to act as External Fund Managers (in case no authorization is required by relevant legislation), by Dec. 31, 2024.
Regulated entities authorized, appointed or approved to act as External Fund Managers by Dec. 31, 2024 that made no use of authorisation/appointment, must also submit it.
Form must be successfully submitted electronically via Transaction Reporting System (TRS) by May 30, 2025, at the latest; steps to follow for successful submission-online.
Upon submission, entities are responsible to ensure they have received a feedback file.
I.e. official submission confirmation dispatched by TRS in Outgoing directory.
Feedback file will either contain NO ERROR indication or, in case of error/s during submission, it will contain a description of that/those error/s.
In case of errors entities must review form, ensure all errors addressed and corrected.
That, before digitally signing (only applicable for Excel files) and re-submitting it.
Form regarded as being successfully submitted only when NO ERROR indication feedback file is received, within the deadlines set out.
Emphasized importance of meeting deadline as failure to promptly and duly comply may bear administrative penalties of section 37(5) of CySEC Law.
CYP SEC will not send reminders to Regulated Entities which fail to promptly comply.
