FR ACPR issued Decision 2023-CR-35 of Sep. 25, 2023 requiring the use of electronic signatures for all documents transmitted as part of the work relating to all resolutions.
Follows FR ACPR Aug. 2020 issued regularization e-signature measures, see #85013.
Also follows FR ACPR Dec. 2022 updated AML/CFT OneGate information, see #156333.
Decision Summary
Establishments in Article L613-34 of the Monetary and Financial Code which fall under direct jurisdiction of FR ACPR transmit in OneGate the information required by its decisions, technical documentation, ad hoc requests, or by the director of FR ACPR.
Also second level texts taken in application of BRRD in accordance with the terms provided for by the FR ACPR supervisory college under instruction 2015-I-19 relating to electronic signature of documents transmitted to the FR ACPR by all users.
Applies in same way to establishments which fall under direct competence of ACPR under SRMR for submission of information to OneGate necessary for implementation.
Also for implementation of BRRD or of second level texts adopted or directive or provisions of the Monetary and Financial Code (CMF) dealing with the resolution.
Applicable in New Caledonia, French Polynesia, Wallis and Futuna Islands and Monaco.
Effectiveness
The terms of the decision, covered in the legislation, will now apply from Nov. 1, 2024.
