ICE NGX submitted self-certification to CFTC on amendments to Contracting party agreement (CPA) in relation to confidentiality, indices, trade data and to invoicing.
Amendments
Enhance scenarios in which required disclosure of confidential information permissible, to contemplate compelled disclosure pursuant to subpoena or a similar situation.
Amendments make certain non-substantive changes to improve the drafting and better align the confidentiality provisions applicable to the contracting party and to ICE NGX.
Regarding indices, amendment codifies ICE NGX’s current practices in the rare situation where an index price is not published by relevant third-party index provider.
Codifies current practices in situation where index price published by relevant third-party provider, clarifies provisions on trade data use by stating applicable policies.
Clarifies date on which invoice subject of previous dispute becomes final and binding.
Effectiveness
ICE NGX intends to implement proposed amendments to the CPA on Jul. 21, 2025.
