On Jul. 14, 2025, POL GVT published Act of Jun. 24, 2025 amending Act on Investment Funds and Management of Alternative Investment Funds of May 27, 2004.
The changes are punctual: art 72.1 point 10 is repealed; in art 81c: in para 1, point 10 is repealed; in para 2, the words and 10 are deleted.
Act published as item 935 in OG enters into force 14 days after publication i.e. Jul. 28.
On Apr. 28, POL GVT issued draft act on investment fund depositories.
POL GVT issued draft act amending the act on investment funds and management of alternative investment funds.
Justification
Purpose of the draft act is to eliminate overregulation identified in the scope of the activity of the investment fund depositary.
Serve to ensure compliance of national regulations on investment funds with EU law.
Fundamental purpose of establishing depositary institution in regulations on investment funds is to store and maintain a register of assets, and ensure proper monitoring of flow of funds of investment funds and alternative investment funds.
By storing the assets of an investment fund by a depositary independent of the entity managing the fund, the level of security of investors' funds is increased.
Effectiveness
Comments on the draft act must be submitted by May 7, 2025.
