MCH INS Revised PIP Bodily Injury Form

On Feb. 24, MCH INS issued bulletin re personal, bodily injury limits.

  • MCH INS issued Bulletin 2025-07-INS to revise personal injury protection (PIP) choice forms and bodily injury coverage limits form, which supersedes Bulletin 2023-11-INS.
  • Follows MCH INS Apr. 2023 bulletin on changes to PIP Choice Forms, see #169440.
  • PIP Coverage Limits
  • The new form contains a revised cover page to provide explanation of PIP coverage.
  • Contains expanded definitions section to clarify existing definitions, add definitions for allowable expenses, family-provided attendant care, unlimited PIP medical coverage.
  • PIP medical definition removed because it is described in revised form's cover page.
  • Made clarifying changes to Section A re PIP Medical, and Section B re Certification.
  • The PIP Medical Coverage Form for commercial policies was amended to implement clarifying changes for consistency with the PIP Medical Coverage Form for individuals.
  • Auto insurers must offer applicants and insureds a choice of PIP medical limits for policies issued/renewed after Jul. 1, 2020, and insurers can use PIP form or their own.
  • Insurers that wish to use new/revised form must submit proposed PIP choice in a form filing no fewer than 30 days before form effective date, but no later than Jun. 1, 2025.
  • Insurers and producers must ensure that consumers who are purchasing or renewing coverage know of their eligibility to opt out of purchasing PIP medical coverage.
  • Opt out option applies if they have a QHC deductible which is currently $6,579 or less.
  • Bodily Injury Coverage Limits
  • Automobile insurers required to use the MCH INS Bodily Injury Liability Coverage Limits Form (the BI Form), which was not amended but is republished for convenience.
  • Automobile insurers are required to use the form when offering applicants and insureds no-fault automobile insurance that will be issued/renewed after Jul. 1, 2020.
  • Insurers and producers are required to offer, at the time of application or renewal, a list of all bodily injury options that are available from that insurer and price per option.
  • Effectiveness
  • Insurers that wish to use a new or revised form must submit their proposed PIP choice form no fewer than 30 days prior to form effective date, but no later than June 1, 2025
