On Mar. 20, ARK LEG enacted bill re access to title insurance records.
ARK LEG approved HB 1367 in order to amend the Arkansas title insurance act and in order to regulate access to public records by a title agent as well as a title company.
Adds (e) and (f) to Arkansas Code,ARK INS 23-103-417 (access to public records).
Access to Public Records
If a government/official maintains, compiles, or keeps instruments of record affecting real property in electronic format, must timely provide the records in electronic format.
Records not provided in electronic format, must be in form of mechanical production.
Such records must be sent to the title insurance agent, agency or an affiliated person.
An instrument of record affecting real estate that is provided under subdivision (e)(1) must not bear any watermark/other notation that does not appear on original record.
A fee not to exceed $150 per month may be charged for providing the instruments.
