DEN GVT issued draft executive order, consultation letter, and hearing list on the designation of competent authorities and digital communications covered by NIS2.
Refers to Directive on security of network and information systems (NIS2).
Further to L141, Feb. 6, 2025, the Minister of Public Security and Emergency Preparedness (Minister) refers to section 20 of that bill accordingly.
Minister, after negotiation with the relevant minister, shall lay down rules on which authorities shall perform the function of competent authority within a given sector.
Includes competent authority withing a sub-sector, or for a specific type of entity, and also as per s. 31, L141, the Minister must lay down the rules on digital communication.
In addition, the executive order lays down rules on digital communication in relation to registration as per ss. 9-10 of NIS2 and notification as per ss. 12-14 of NIS2.
It also states an entity's possibility of exemption from digital communication and communication if an entity cannot access the designated self-service solution.
Effectiveness
Minister expects comments no later than May 16, 2025.
Draft executive order is expected to come into force on Jul. 1, 2025.
