MD LEG passed HB 102 (SB 225) on wage/eligibility for increases in benefits for Family Medical Leave and Insurance Program (FAMLI), and to adopt optional self-enrollment.
Delays the FAMLI Program’s start dates for required contributions, benefit payments.
Defined anchor date which establishes reference points to calculate certain covered employee’s average weekly wage and eligibility for increases in weekly benefits.
Requires MD DoL to establish the voluntary self-enrollment for the participation of self–employed individuals, repealing requirements for their contributions into the program.
On/before Jul. 2028, Secretary will adopt regulations to establish optional self-enrollment with contribution and benefit amounts as well as enrollment procedures.
On or before Oct. 1, of each year, Secretary will submit, an annual report, conduct a cost analysis, and report results on the administration and operation of the program.
Starting Jan. 1, 2027, each employee and each employer with 15 or more employees will contribute to the fund, and total rate of contribution will be set by May 1, 2026.
The total rate of contribution will be in effect from Jan. 1, 2027 to Dec. 31, 2027.
From Jan. 1, 2027 and no later than Jan. 1, 2028, covered individual taking leave from employment may submit claim for benefits for newborn, adoption, sick family member.
From Sep. 1, 2027 and each Sep. 1, Secretary will report on annual percentage growth, weekly benefit amount which is effective with anchor date before the increase.
Additionally, MD DoL may not require employers who are allowed to pool together with other employers, to purchase insurance before the issuance of the program benefits.
