On Oct. 9, POL GVT issued Reg on method, procedure for concluding agreement.
POL GVT published Regulation 1309/2026 of the Council of Ministers of Oct. 2, 2026, amending regulation on the method and procedure for concluding an agreement on the basis of which membership in an open pension fund is obtained.
Overview
Amendments made to Reg of Dec. 20, 2011 on manner and procedure for concluding an agreement pursuant to which membership in an open pension fund is acquired (OG, item 1669).
Person intending to join an open pension fund shall apply it by correspondence, in written form, in electronic form permitting content to be stored on a durable medium.
Or in documentary form permitting the content to be stored on a durable medium, using the membership agreement application form made available by that fund.
Open pension fund member who got married, to notify relevant fund without undue delay, of matrimonial property arrangements in force between member/their spouse.
Previous provisions will govern matters initiated but not concluded before the date of entry into force of this Reg; inter alia including acquisition of membership in an open pension fund, submission of declaration referred to in art 82a of Act of Aug. 28, 1997 on Organisation and Operation of Pension Funds (OG 2026, items 1070 and 1098).
Submission of declaration concerning matrimonial property arrangements of a member of an open pension fund, and notification of open pension fund of each change to content of such declaration, relating to funds accumulated in the member’s account.
Effectiveness
Regulation shall enter into force after expiry of 14 days from date of its publication, i.e., Oct. 23, 2026; except for s1(6) re members’ personal details and address updates, in force 3 months from publication, i.e., Jan. 9, 2027.
