On Oct. 7, 2026, ESP GVT officially published RDL 28/2029 adopting urgent measures to strengthen the stability of residential lease agreements.
This RDL revises art 10 Law 29/1994 with dual objective: to guarantee continuity of primary residence lease agreements beyond minimum term and to ensure that, when landlord decides not to continue, tenant has time, means to secure alternative house.
RDL 29/2026 had already revised art 10, Section 1 of the same law, to limit its scope to primary residence leases while maintaining the annual tacit renewal regime.
This one builds upon that revision and replaces the said regime with one described.
I.e. upon expiration of the contract or any of its renewals (provided minimum duration of 5 years has elapsed -or 7 if landlord is legal entity-, contract shall be renewed for successive same periods, unless either party notifies of intention not to renew it.
Notice period required of landlord is increased to 6 months, allowing tenant sufficient time to plan a move while the notice period for the tenant remains at 2 months.
Contract continuity thus becomes rule, while termination becomes express decision by the landlord that must be made at specific times and with sufficient advance notice.
More details provided in preamble and in the articles themselves; the new rules, if approved by the Congress Standing Committee, will enter into force on Nov. 15, 2026.
On Oct. 7, ESP GVT issued 21 measures facilitating access to housing.
ESP GVT Council of Ministers approved 21 measures to facilitate access to housing.
On the same day ESP Tax issued release re tax measures in RDL 29/2026 of Oct. 6.
Follows Sep. 2026 ESP GVT issued 2 RDLs on housing-related matters, see #314493.
Overview
The measures seek to promote access to affordable rental and purchase housing, increase supply of housing and provide stability to tenants and small landlords.
But also protecting the most vulnerable people and combatting speculation in sector.
2 RDLs address one of the problems that most concerns citizens i.e. access to housing.
PM Sanchez explained the texts maintain essence of those approved on Sep. 29 that lost validity after not being ratified by the Congress on Oct. 2, 2026.
To these reasonable and necessary measures, some other very positive are added.
With ESP PRL dissolution and calling of general elections the RDLs must now be ratified by the Standing Committee of the Congress.
Key Aspects
Among the approved measures are tax benefits, loans and increased housing supply.
First measure is to facilitate access to affordable rental housing and homeownership.
Tenants will be able to deduct part of rent payments from their income tax returns.
In case of a monthly rent of €800, for example, deduction will be close to €1,000.
Small landlords will benefit from tax incentive if rent their homes at affordable prices.
Further, a financing line of €10 billion is being created to offer interest-free loans of up to €50,000 to those wishing to purchase their first home.
Managed by ICO, the credit line is intended to be intergenerational.
Second key objective is to increase housing supply so €280 million allocated to loan guarantees to promote industrialized housing construction, shortening construction times and leading to increase in supply more quickly.
Additional €400 million will be dedicated to supporting social housing providers.
Further, public entity Casa 47 will acquire thousands of properties from the Social Security system to facilitate access to housing for the most vulnerable groups.
Other Aspects
Decrees will serve to provide reassurance and stability, according to the Prime Minister.
One extends rental contracts for up to 2 years for those who are up to date with their payments and limits rent increases, the other establishes automatic extension of these rental contracts upon expiration, except in certain circumstances.
Sánchez acknowledged there is currently no parliamentary majority to ratify the second, so it will not come into effect at same time as the first i.e. after publication in OG but rather after its ratification by the Standing Committee, if that occurs.
Important to establish clear rules: when contracts are renewed, when expire, in what cases landlords can reclaim properties as small landlords are crucial to solve the crisis.
The legislation also incorporates protections for vulnerable individuals without alternative housing, without placing that burden on small landlords.
Re speculation, seasonal and room rentals decrees limit property purchases by so-called vulture funds, link tax benefits of Listed Real Estate Investment Trusts (REITs) to affordable rentals and tax tourist apartments as businesses.
