UTA LEG enrolled Bill SB 201 to amend Utah code provisions related to real estate.
Aims to establish certain lease terms, set homeowners' association fees and meetings.
Real Estate Provisions
Homeowners' association authorized to establish a minimum lease term of six months or less, specifies that rental association fee does not apply to certain exempt persons.
May charge a fee to an owner that owns a rental within homeowners' association once every 12 months, requires a meeting be held before approving/imposing a rental fee.
Gives owner the option to contest the fee established by the homeowners' association.
A representative of a homeowners' association may act as attorney-in-fact for owners in order to dispose of common areas, and changes restrictions for certain landscaping.
Homeowner can designate another individual as primary contact for the homeowner.
Condominium owner is required to provide notice to the developer and give them an opportunity to repair alleged design or construction defect before filing a lawsuit.
