LUX CSSF issued circular on replacement of secure exchange channel for notification and enforcement of court orders and repeal of LUX CSSF circular 13/566 on subject.
Overview
Addressed to credit institutions, informs that secure electronic exchange channel e-file for notification and enforcement of court orders will be replaced by MyGuichet.
Replacement concerns judicial orders issued by investigating judges on basis of Code of Criminal Procedure, law on international mutual legal assistance in criminal matters.
Change is part of program to digitize judicial administration and secure data exchange.
LUX CSSF includes a data sheet with the circular, setting out technical details and how to register with new secure information transmission system via MyGuichet platform.
Credit institutions must comply with procedure as set out to ensure data transmission.
In event of an internal change at a credit insitution that may have an impact on the transition of required information, should notify authorities immediately, update data.
The circular repeals LUX CSSF circular 13/566 of Jun. 6, 2013.
Effectiveness
The MyGuichet electronic platform will become operational on Oct. 16, 2024.
Sep. 2024 Update
On Sep. 9, 2024, LUX CSSF issued circular 24/862 amending in two points Cir 24/859.
Cir 24/862 changes the date of the implementation of the new secure exchange channel for notification and the execution of court orders, namely Nov. 6, 2024.
