On Jun. 26, 2025, EU CMSN issued Commission Delegated Reg 2025/1253 of Feb. 11, 2025 amending Delegated Reg 2019/1122 supplementing Dir 2003/87/EC of the EP and of the Council as regards the functioning of the Union Registry.
Reg 389/2013 is repealed with effect from Jan. 1, 2021; however, Reg 389/2013 shall continue to apply until Jan. 1, 2026 to all operations required in relation to the trading period between 2013 and 2020, to the second commitment period of the Kyoto Protocol and to the compliance period as defined in Article 3(30) of that Regulation.
This Regulation shall enter into force on the twentieth day following publication in the Official Journal of the EU, i.e. Jul. 16, 2025; it shall apply from Jan. 1, 2021, with the exception of Article 87, which shall apply from the day of entry into force.
On Aug. 6, EC flagged consultation on changes due to Fit for 55.
EC announced upcoming consultation on 2nd batch of updates to Registry Regulation.
As part of the Fit for 55 package, the ETS Directive has been revised to align it with the new EU target to reduce net greenhouse gas emissions by 55% by 2030.
Following the revision, EC must update several regulatory acts for ETS implementation.
This initiative forms a second batch of updates to the Registry Regulation to introduce rules on aviation, fees to finance Union Registry, ETS for buildings and road transport.
Effectiveness
Commission adoption of the delegated regulation is planned for Q4 2024.
Feb. 2025 Commission Adoption
On Feb. 11, 2025, EU CMSN adopted delegated regulation amending delegated reg (EU) 2019/1122 supplementing dir 2003/87/EC re the functioning of Union Registry.
Amendments introducing elements of simplification/clarification revealed from practice.
Subject to scrutiny period, usually 2 months, during which EP and Council may object.
C(2025)814 and its annexes enter into force on the day of its publication in the OJ.
Article 1, points (2), (3), (5), (8) and (12), and Annex I, Annex III and Annex V, point (1), shall apply from Jan. 1, 2025.

Mar. 2025 Extension of Time Limit
On Mar. 14, 2025, EU CNCL issued item note concerning extension of the time limit.
During the written consultation of Working Party on the Environment, which expired on Mar. 7, 2025, 2 delegations requested an extension of the period for raising objections.
The Working Party on the Environment examined the delegated act at its meeting on Mar. 14, 2025, where a majority of delegations expressed support for an extension.
It is therefore suggested that Coreper recommend that the Council decide to extend the period for raising objections by 2 months, i.e. until Jun. 16, 2025.
Jun. 6, 2025 EU CNCL No Objection
On Jun. 6, 2025, EU CNCL confirmed no intention to object to the delegated act.

The Working Party on Environment has examined the delegated act and agreed that there are no grounds for EU CNCL to object to it; therefore suggested that Coreper recommends EU CNCL confirms that it has no intention to object to the delegated act.
Unless EP objects, the delegated act shall enter into force on the day after publication in the EU Official Journal, in accordance with Article 2 of the Delegated Regulation.
