COL INS proposed amended Regulation 4-2-27 concerning the procedures for reasonable modifications to individual plans and to small group health benefit plans.
Follows Jan. 2023 amendments removing applicability to pediatric stand-alone dental plans compliant with Affordable care act (ACA) from the existing regulation, #153682.
Amends Code of Colorado regulations, COL INS 3-702-4 (Life, accident, and health).
Proposed Amendments
Adds renewed definition to mean a policy renewed upon earliest of annual anniversary date of issue, date premium rates can be changed, date benefits can be changed.
If policy allows for change in premiums or benefits due to changes in state or federal requirements and not considered a renewal, then change is not considered a renewal.
Requires carriers to file a reasonable modification filings for health benefit plans that are being renewed, in accordance with the rules in Section 5 of Regulation 4-2-27.
In event carrier is not making changes to non-grandfathered health benefit plan during the reasonable modifications request period, filing required to be submitted in SERFF.
The SERFF filing must include a cover letter explaining no changes and utilizing the policyholder's notice in accordance with COL INS Regulation 4-2-82, see #239806.
