Follows POL GVT Mar. 2024, proposed amendments to implement DSA, see #205164.
Summary
Poland remains one of the few EU countries that has not yet aligned its national regulations to DSA, and further delays could result in large penalties being imposed.
The bills aim to better protect internet users and facilitate enforcement of their rights against online platforms; ensure more effective tools to combat illegal content.
And streamline the system of oversight of digital services and largest platforms.
DSA establishes common EU rules for online platform liability, to create a safer and more transparent online environment while respecting freedom of expression.
POL GVT said the president’s veto of DSA implementation Act in Jan. 2026, prevented protection of Polish citizens from unfair practices including online platforms/exposed entrepreneurs to non-enforcement of e-commerce equal competition principles.
First draft act aligns national legal system to DSA, designates Office of Electronic Communications (UKE) president as digital services coordinator overseeing application, handling citizen complaints, cooperating with EC/other member states’ authorities.
Second draft law introduces a national procedure for blocking access to illegal content.
In particularly urgent cases, authorities' decisions may be immediately enforceable.
To protect against excessive content removal, an appeals process for parties to the proceedings will enable objections; also aims to strengthen internet user protection.
Next Steps
The new regulations will generally enter into force 30 days after publication in Journal of Laws, while the second draft will enter into force 3 months after their publication.
In Jul. 2026, POL DP said draft DSA law requires strengthening data protection, see #306008.
Sep. 2026 Act Signed by President
On Sep. 28, 2026, POL DP announced President of the Republic Karol Nawrocki signed a law implementing some of the provisions of the EU Digital Services Act (DSA).
Follows POL DP Jul. 2026 said draft DSA law requires strengthening data protection, see #306008.

Establishes President of Office of Electronic Communications will be the primary authority overseeing application of new regs, serving as coordinator for digital services.
It also introduces provisions on administrative fines for indirect service providers who fail to meet their obligations under the Digital Services Act.
Act currently awaits official publication; in force 30 days after date of OG publication.
