CZC CB issued notice on EBA Guidelines on supervisory cooperation and exchange of information between ESAs and competent Authorities under regulation 2022/2554.
Known as the Digital Operational Resilience Act (DORA) regulation.
Follows CZC GVT Oct. 2024, sought views on draft digital finance law, see #187699.
EBA guidelines on supervisory cooperation are developed as per mandate granted to the European Supervisory Authorities (ESAs) under art. 32(7) of DORA regulation.
Supervisory cooperation provisions ensure compliance with the recommendations under art. 35(1)(d) of DORA addressed to critical third-party ICT service providers.
Guidelines on supervisory cooperation relates to exchange of information between the European third-party supervisors and the relevant national authorities.
For example, in the case of the CZC CB and the relevant supervisory authority.
Guidelines consist of a general part defining the language, secure means of communication for the exchange of information or contact points.
Also, guidance sets out a procedure for resolving differences of opinion between the ESAs and the national supervisor and escalation process to European third-party.
This is the European third-party supervisor, which will be the Oversight Forum.
The emphasis is on the effective exchange of information between national and European supervisors to identify critical suppliers (e.g. third-party register).
Includes relevant information gained from cooperation with national NIS2 authority.
CZC CB will proceed in its supervision as per effectiveness date of the guidelines.

Guidelines on Supervisory Cooperation enter into force on Jan. 17, 2025.
