Overview
The Online safety act 2023 (OSA 2023 (UK)) gives certain internet services new duties to protect their users from illegal content and activity online.
The regulations insert new Sexual offences act 2003 offences into OSA 2023 (UK) Sch 7 priority offences and relate to individuals sharing, or threatening to share, intimate images of others without consent (Intimate Image Abuse offences or IIA offences).
These were recently inserted into the Sexual offences act 2003 in new S 66B by S 188 of the OSA 2023 (UK) and came into force on Jan. 31, 2024.
The regulations also removed an offence from OSA 2023 (UK) priority offences Sch 7.
This is the offence in Criminal Justice and Courts Act 2015 S. 33 about disclosing, or threatening to disclose, private sexual photographs/films with intent to cause distress.
This offence was repealed by the OSA 2023 (UK) when the new Sexual offences act 2003 IIA offences came into force; however, the repealed offence is still included in the OSA 2023 (UK) priority offences schedule (paragraph 30 of Sch 7).
