On Nov. 22, NY LEG enacted bill re provision of criminal history record.
NY LEG enacted Bill AB 6637 (SB 940) so that certain entities may not require person to provide copy of his or her criminal history record under certain circumstances.
Bill Provisions
Amends NY Executive LawNY LEG 18-15-296 to make it an unlawful discriminatory practice for certain entities to require an individual to provide criminal history record.
No person, agency, bureau, corporation, association, the State or any political subdivision shall require an individual to provide a copy of criminal background check.
Paragraph (f) added to subdivision (3) of NY Education LawNY LEG 16-1-7-313(3)(f) to prohibit education institution to require persons to provide certain criminal history.
Bill provisions apply to records provided by the NY division of criminal justice services.
