On Sep. 30, ALA LEG real estate commission proposed to amend rules
ALA LEG Real estate commission published rule amendments and a proposed new rule in State register, including rules on licensing, continuing education, and advertising.
Amends provisions of Title 790 (ALA LEG 790), Alabama Real estate commission.
Proposed Amended Rules
Amend rule on license requirements to eliminates requirement for coordinator of repairs and maintenance for a property under management to have real estate license.
Also proposed rule to clarify that qualifying brokers, as opposed to associate brokers, are the persons who should be entering out-of-state co-brokerage agreements.
Third rule eliminates the limit on the number of hours of credit can be earned in a day.
Adds language required on reciprocally licensing spouses of active-duty military.
Eliminates the requirement for distance education classes with class sizes under 10 students to have an additional moderator, but remains for classes that are 10 or larger.
Requires licensees to use legal surname in licensed real estate activities and marketing as an agent, clarifies nicknames can be used in place of first names, not last names.
Removes requirement for files to be kept at business, files can be kept electronically.
Mutual release pertaining to earnest money can only be entered after transaction fails.
New estimated closing statement to be provided by agent to the client for every offer.
Proposed New Rule
Proposed new rule, ALA LEG 790-X-3-.16, on advertising, to define word prominently in the context of advertising the name of the real estate company or qualifying broker.

Dec. 2024 ALA LEG Final Adoption
On Dec. 31, 2024, ALA LEG reported final adoption of amended, certified new rules.
Reported that proposed new rule, ALA LEG 790-X-3-.16, was adopted without changes.
