On Sep. 23, ITA GVT issued decree implementing the EU CER directive
ITA GVT issued DLgs 134/2024 implementing the EU CER directive into national law.
Follows ITA GVT Feb. 2024 issued delegating law to implement EU directives #202371.
Overview
The decree establishes measures to ensure essential services for maintenance of vital functions of society, of economic activities e.g. banking, public health and safety or environment, in art 2 para 1e, are provided without impediments (details in annex).
Also criteria for identifying critical entities referred to in art 2 para 1a; obligations for entities referred to in said article, aimed at strengthening their resilience, up to achieving high level and to strengthen their ability to provide essential services.
Measures to support fulfillment of obligations imposed from this decree to critical entities of art 2 para 1a; supervision and imposition of penalties on critical entities.
Rules re identification of critical entities of particular EU relevance referred to in art 17, and EC advisory missions aimed at evaluate measures put in place by these entities to comply with own obligations, pursuant to art 18.
Rules for preparation of national strategy for resilience of critical entities, in art 6.
Risk assessment by State (art 7) and risk assessment by critical entities (art 13).
Creation of Inter-ministerial Committee for resilience referred to in art 4, as well as identification of competent sectoral authorities and single point of contact of art 5; etc.
Effectiveness
Decree shall apply from Oct. 18, 2024 date on which DLgs 61/2011 will be repealed.
