COL INS proposed Amended Regulation 4-2-65 in order to establishment requirements for a carrier payment dispute arbitration program for out-of-network providers.

Carrier Payment Arbitration
Arbitration request will be withdrawn if out-of-network provider fails to notify the COL INS within 3 business days of the carrier's refusal to participate in informal settlement.
If the out-of-network provider or the carrier fails to notify the Commissioner of the outcome of informal settlement teleconference, arbitration request will be withdrawn.
If arbitrator was already assigned at the time of termination and arbitrator can show work was initiated on the request, requester must pay arbitration fee to the arbitrator.

On Sep. 27, 2024, COL INS published hearing notice re amendingRegulation 4-2-65.
The hearing will be held on Oct. 31, 2024, where oral comments can be presented.
Comments are due by Nov. 5. 2024, and regulation becomes effective on Jan. 1, 2025.
