NY LEG issued Executive Order 38.1, declaration of disaster in the State of New York.
EO 38.1 in response to tropical Storm Debby extends disaster emergency declared in EO 38 of Aug. 9th for all counties in the State of New York until Oct. 6, 2024.

EO 38.1 Highlights
Storm Debby produced heavy rainfall, severe thunderstorms, and flash flooding.
The storm resulted in road closures, travel disruptions, widespread power outages.
Also, damaged public and private property, which poses an ongoing threat to public health and safety, for which affected local governments unable to respond adequately.
Effectiveness
EO 38.1 is effective immediately and declaration remains in effect until Oct. 6, 2024.
On Sep. 25, 2024, FEMA reported federal disaster assistance due to Aug. 8-10 storms.
On the same day NY LEG published EO 38.1 disaster declaration in the State register.
On Sep. 24, 2024, White House, NY LEG reported disaster declaration issued for NY to support recovery efforts in areas affected by Tropical Storm Debby from Aug. 8-10.
Federal assistance available in Allegany, Broome, Delaware, Essex, Franklin, Jefferson, Ontario, Steuben, St. Lawrence and Yates Counties and via hazard mitigation program.
Federal funding also available on a cost-sharing basis for hazard mitigation measures.

On Oct. 4, 2024, NY LEG Governor Hochul issuedExecutive Order 38.2 extending Executive Order 38 and its successor Executive Order 38.1 until Nov. 3, 2024.
