On Aug. 6, IND MCA amended process on adjudication of penalties.
IND MCA published the Companies (adjudication of penalties) amendment rules, 2024 (gazetted on Aug. 5) to amend the Companies (adjudication of penalties) rules, 2014.
Key Amendments
The 2014 rules are amended to provide that all adjudication proceedings shall be conducted electronically via the Central Government’s e-adjudication platform.
Applies to all steps re notices, filing of replies, witness attendance, payment of penalty.
Includes guidance on handling cases where an email address is incorrect/ unavailable.
Newly inserted rule 3A states holding of a hearing and attendance of witnesses is to be conducted only via the e-adjudication platform; physical attendance is not required.
Effectiveness
The amendments come into force in accordance with rule 1(2), on Sep. 16, 2024.
