IND MCA Platform for E-Adjudication


On Aug. 6, IND MCA amended process on adjudication of penalties.


  • IND MCA published the Companies (adjudication of penalties) amendment rules, 2024 (gazetted on Aug. 5) to amend the Companies (adjudication of penalties) rules, 2014.
  • Key Amendments
  • The 2014 rules are amended to provide that all adjudication proceedings shall be conducted electronically via the Central Government’s e-adjudication platform.
  • Applies to all steps re notices, filing of replies, witness attendance, payment of penalty.
  • Includes guidance on handling cases where an email address is incorrect/ unavailable.
  • Newly inserted rule 3A states holding of a hearing and attendance of witnesses is to be conducted only via the e-adjudication platform; physical attendance is not required.
  • Effectiveness
  • The amendments come into force in accordance with rule 1(2), on Sep. 16, 2024.
