NJ LEG passed SB 1313 / AB 3330 on procedure for certification of LGBTQ+ business.
Bill codifies the program established by Governor Murphy in Executive Order No. 295.
Bill Provisions
In order to be eligible as LGBTQ+ business, a business shall be a sole entity which is at least 51% percent owned, operated, controlled by person who identify as LGBTQ+.
A first-time applicant for certification as an LGBTQ+ business shall submit documentation necessary to determine the applicant’s eligibility for certification.
Division shall prepare a NJ uniform certification application the must be available online on the division's website; application must include certain information or fields.
NJ must also prepare a form for recertification available on the division's website.
Upon approval of an application, a certificate issued is valid for 5 years, subject to the annual certification verification statement, must reapply for certification after 5 years.
Specified that the division may deny or revoke the certification of a LGBTQ+ business if the division has determined that the applicant has failed to meet certification criteria.
