On Sep. 25, 2025, SLV ATVP announced Board adopted General Act on Key Elements of Investment Fund and Types of Investment Funds and General Act on Formation of Investment Fund Companies and Investment Fund Companies and another one.
The acts were adopted on basis of provisions of Investment Funds and Investment Fund Companies Act (ZISDU-3) both in force on 15th day after publication in OG.
On Aug. 13, SLV ATVP issued draft general acts in the ZISDU-3 field.
SLV ATVP launched consultation on 2 draft general acts in the field of ZISDU-3.
Draft act on key elements of investment funds and types of investment funds and draft act on management company and Member State management company reporting.
Types of Funds
It covers key elements that collective investment undertaking must meet, more detailed types of UCITS according to general characteristics of their investments.
Division and naming of types of UCITS according to specifics of investments in which the fund has invested its assets, or according to asset management techniques used by the fund for purposes of efficient investment management.
Concept of additional liquid assets, their types, characteristics, method to determine size of additional liquid assets and their ratio to size of other assets of mutual fund, and their maximum permissible volume.
Management Company
Draft deals with content and method of reporting by management company in relation to the management company's qualified holders, content, method and deadlines for reporting to SLV ATVP on the capital adequacy of the management company.
Also content, method and deadlines for reporting on transfer of individual services or investment fund management transactions and changes to the transfer agreement.
Method and deadlines for submitting changes to investment fund's risk management plan and method, deadlines for reporting information referred to in art 187.5 ZISDU-3.
As well as content, method and deadlines for regular reporting by management company and management company of Member State referred to in arts 454 and 456 ZISDU-3 to SLV AVTP.
Plus reporting at its request referred to in art 455 of ZISDU-3; draft contains an annex.
