On Jun. 4, EUREX Clear amended technical connection agreement.
EUREX Clear announced changes to the General Terms and Conditions to the Agreement on Technical Connection to the Clearing EDP of Eurex Clearing AG.
Overview
Third-party software must be registered; third-party software that a contractual party obtains from an independent software provider for connection to the Clearing EDP can only be registered if independent software provider also registered with EUREX Clear.
Details on registration of third-party software, independent software providers are in section 3.§ 9 Number 3 of GTC to Connection Agreement, stating contractual parties must register third-party software prior to connection to EUREX Clear clearing EDP.
Explained that third-party software that a contractual party obtains from a software provider (known as independent software vendor - ISV) for connection to the clearing EDP can only be registered if the ISV has also registered with EUREX Clear.
Prior to connection to Clearing EDP, contractual parties must notify EUREX Clear which third-party software will be used to connect to Clearing EDP via FIXML, FpML interfaces.
Registration and notification must be carried out via an electronic platform provided by EUREX Clear for this purpose; detailed provisions for registration are available here.
For orderly Clearing EDP processes, § 9 Number 4 of GTC to Connection Agreement authorizes EUREX Clear Executive Board, among other things, to prohibit connection of third-party software to Clearing EDP, interrupt existing third-party software connection.
EUREX Clear legal framework amendments published by this circular are deemed accepted by each affected contractual party of EUREX Clear, unless the respective contractual party objects by written notice to EUREX Clear prior to effective date.
In case of an objection, EUREX Clear is entitled to terminate the respective contract.
Instead of submitting an objection, respective contractual party may submit in writing to EUREX Clear comments to any amendments of the EUREX Clear legal framework within the first 10 business days after the publication of the amendments.
EUREX Clear shall assess if these comments prevent the published amendments from becoming effective, taking into account EUREX Clear and contractual party interests.
Effectiveness
Amended GTC to the Connection Agreement is in force from Jun. 30, 2025.
