On May 21, UK GVT amended order on whistleblower protection.
UK GVT issued Public Interest Disclosure (Prescribed Persons) (Amendment) Order 2025 (StIn 2025/604), amending 2014 order to add sanctions-related functions as prescribed matters in relation to specified Secretaries of State as prescribed persons.
Concerns secretaries of state for business and trade; transport; and UK Treasury.
Whistleblower Protection
Employment Rights Act 1996 (ERA 1996 (UK)) provides protection for workers who suffer detriment or are dismissed as a result of whistleblowing by making a qualifying disclosure within meaning of s 43B in accordance with any of ss 43C to 43H of the Act.
S 43F provides that a worker will be protected by 1996 Act if they make a qualifying disclosure to a person prescribed in 2014 Order reasonably believing that the failure disclosed falls within the matters in respect of which that person is prescribed.
Also, that information disclosed, any allegation contained in it, are substantially true.
The Schedule to the 2014 Order lists the prescribed persons and prescribed matters.
2025 Order amends Schedule to 2014 Order to prescribe matters for which Secretaries of States for Business and Trade, Transport, Treasury are prescribed persons.
Newly prescribed matters concern sanctions-related functions of prescribed persons.
Effectiveness
Order enters into force on Jun. 26, 2025.
