POL GVT consulted on bill UDER27 to amend Act on Compulsory Insurance, Insurance Guarantee Fund, Polish Motor Insurers' Bureau and the Act on Population Registration.
Overview
The aim of the bill is to limit situations in which compulsory third-party liability insurance contracts for motor vehicle owners for damages resulting from the movement of these vehicles are concluded using stolen personal data.
The increasing number of thefts of PESEL numbers from various registers has led to criminals using them to conclude compulsory third-party liability insurance contracts for motor vehicle owners, which are concluded on the basis of stolen personal data.
Now insurance companies do not have right to verify reservation of a PESEL number in register of reservations of PESEL numbers, so, when concluding third-party liability insurance contracts for motor vehicle owners, do not have data on such reservation.
Key Aspects
Proposes to introduce changes to Act of May 2003 on compulsory insurance, Insurance Guarantee Fund, Polish Motor Insurers' Bureau and Act on Population Register.
The changes to Act on compulsory insurance, etc assume granting right to verify the reservation of PESEL number for insurance companies in scope of third party liability insurance contracts for motor vehicle owners.
Per currently applicable regulations, insurance company offering compulsory insurance does not have possibility to refuse to conclude such a contract.
Thus, proposed to modify regulations in such way that in event of reservation of PESEL number, insurance company will be able to refuse to conclude the contract.
Amendments to Act on Population Registration assume extension of catalogue of entities to which data on PESEL number retention will be made available to include insurance companies and the Insurance Guarantee Fund.
Consultation
Per Resolution 190/2013, Minister of Finance asked comments to the bill in editable electronic version sent to email address provided by May 15, 2025.
Shortened deadline dictated by deregulation goal of bill, which is of special legislative importance, as well as by the narrow scope of its regulation.

Failure to submit position within deadline will be considered agreement on bill content.
Effectiveness
Consultation closes on May 15, 2025; act in force after 3 months after its publication.
