UTA LEG issued bill SB 274 S02, regarding health insurance preauthorization revisions.
Bill would amend UTA INS 31A-22-650 to requires health insurers to provide information related to preauthorization to UTA INS, patients, health care providers.
Further, the bill would amend UTA LEG 63I-1-231, in order to create a repeal date.
Health Care Preauthorization
Required insurers report to UTA INS before Mar. 1, 2026, and each Mar. 1 thereafter.
Report a list of services that have preauthorization requirements; for pre-service preauthorization requests that were not urgent, individual service request percentages
Percentages of requests approved, denied, approved after appeal, time frame for review was extended and request was approved, and denied due to incomplete data.
Also, percentage of requests received through fax, phone and electronic portal.
For urgent requests, percent approved denied, denied due to incomplete information from health care provider, requests received through fax, phone, and electronic portal.
Data to be aggregated for all services, reporting not required on prescription drugs.
Information described required to be compiled and published on the UTA INS website.
Adverse Preauthorization Determination
Required notices for each adverse preauthorization determination made by an insurer.
Must provide certain information to the enrollee and enrollee's health care provider.
A detailed and specific explanation that explains why the determination was made.
Notice explaining determination may be appealed, process, how to expedite appeal.
Repeal Dates
Subsection UTA INS 31A-22-650(5)(b), regarding reporting requirement that includes number of preauthorizations that were approved, denied, to be repealed Jul. 1, 2029.
UTA INS 31A-22-650(8), preauthorization reporting rulemaking, repeal Jul. 1, 2025.
